The Hamas case: “In the matter of an application for deproscription”

Robert Jenrick, shadow lord chancellor and justice secretary has said it is ‘sickening’ to see a London law firm argue that Hamas should no longer be designated as a terror group’.

Others are joining in the demonisation of those lawyers involved in representing Hamas.

In our view it is clearly in the public interest for the case to be heard.

For the benefit of our readers, we provide a detailed outline of the issues at stake in the post below.

Essentially, Hamas has invited the British Secretary of State for the Home Department to reconsider its proscription of Hamas as a Terrorist Organisation on the grounds that it is:

  1. contrary to the duties of the British State to (a) end genocide, (b) end crimes against humanity, (c) bring to an end the occupation of the occupied Palestinian territory, and (d) recognise the Palestinian people as full members of the human family, equal in dignity.09
  2. incompatible with arts.10, 11 and 14 of the European Convention on Human Rights (‘ECHR’), because it unlawfully restricts the freedom of speech and assembly of those with whom the British State politically disagrees.
  3. disproportionate because Hamas does not pose any threat to Britain or British citizens; its proscription undermines the democratic process by seeking to eliminate from the political process the party which has won the only free and fair election in the oPt; impedes humanitarian relief efforts; and results in the mass criminalisation of Palestinians.

  • the political will of UK gov. will eventually overcome the incontrovertible evidence presented in this case for Hamas. It will make fascinating reading for how they achieve this once the case is heard.

    Thankyou JVL – for this exhaustive and exhausting justification for the submission presented to the UK government for the reversal of its decision to designate Hamas as a terrorist organisation to silence any criticismof the Israeli illegal occupation of Palestine and its genocide in Gaza. It is a vital step in the necessary ending of the inhuman Israeli genocide in Gaza. Despite Israel’s banning any foreign journalists from Gaza and occupied territories; and its unprecedented brutal slaughter of any other jouranalists reporting on the area, enough material has emerged to establish the existance of a genocide without any doubt – and of the complicity of UK government in aiding it.
