Geoffrey Robertson KC, founding head of Doughty Street Chambers, wonders how Labour will pass its first moral test.
The issue is this. Britain under the Tories threatened to intervene against the International Criminal Court’s decision to seek the arrest of Benjamin Netanyahu for war crimes in Gaza.
Bizarrely, it claimed that there are obscure grounds under the Oslo Accords as to why Israelis alone cannot be prosecuted for crimes in Gaza.
This case is due to be made to the ICC by the end of July.
Here Robertson explains why the case is legal nonsense and calls on the new attorney general (a sound international lawyer) and the foreign secretary, David Lammy to withdraw it.

This is outrageous. No one is or should be treated as above the law. The new Labour government should reject it as should the ICC themselves. Meanwhile more and more people are being massacred, Gazans especially children are dying from starvation and the West Bank is being lost. Where are the ethical priorities, the rule of law and the administration of justice. If the ICC were to give in to this rubbish their credibility would be severely damaged. It’s past due time for the US to stop using other countries to do its dirty work as well, while they refuse to accept the jurisdiction of these bodies themselves. There are too many right wing bullies around trying to get away with murder. They all need to be stopped and held accountable.
